You acknowledge and agree that:

Financial contributions to sponsor Ocean Conservation Commitments (OCCs) are received and managed by the Niue and Ocean Wide Trust (NOW Trust), a New Zealand Charitable Trust, consistent with its charitable purposes and subject to its trust deed. Please see the Brochure for additional information regarding the intended use and management of OCC-sponsored funds.

Contributions to the NOW Trust are governed by New Zealand law and subject to the exclusive jurisdiction of the New Zealand courts. A Sponsor’s relationship is solely with the NOW Trust, and not Tofia Niue, the Government of Niue or any other entity. No commitments, or obligations, whether contractual or otherwise, are given or entered into by the Government of Niue, Tofia Niue, or any other entity, to , or with, any Sponsor.

While the NOW Trust will use revenue from OCC sponsorships in furtherance of its charitable purposes, in accordance with its intended use as set out in the Trust Deed and described in the Brochure, the Sponsor acknowledges that the NOW Trust is not responsible for any future policy or legislative changes made by the Government of Niue or the Niue Assembly, including in relation to the size or scope of any current marine protected areas. In this regard, Sponsors to the NOW Trust recognize they contribute to the NOW Trust at their own risk, and agree that they have no recourse to the NOW Trust, Tofia Niue or the Government of Niue for any changes in the Government of Niue’s policies, or changes to any legislation.

The NOW Trust and a particular Sponsor may agree to enter into a particular sponsorship agreement with the NOW Trust with regard to OCCs. Persons seeking to sponsor more than 1,000 OCCs are requested to reach out to the NOW Trust.

The OCCs are not a financial product and will not provide financial value or returns to the Sponsor nor are they a tradeable product that can be transferred to another sponsor (although you can gift the OCCs You sponsor to another person or entity). You also acknowledge that an OCC does not represent ownership or claims over 1km2 of ocean real estate in Niue, nor is an OCC an offset to be used like carbon credits enabling a NetZero target or requiring a verification process following international standards.

In these terms and conditions, “You” and “Sponsor” means a contributor to or sponsor of an OCC.
